A New Chapter in Turkish International Family Law: The Recognition and Enforcement of Divorce Judgments Rendered Abroad

On 29 April 2017, Article 27/A has been added to Law on Civil Registry Services by Statutory Decree No:690 issued under the State of Emergency. The Article regulates registration of divorce judgments produced by foreign judicial or administrative authorities to relevant civil registries.

Decisions given by said foreign authorities concerning marriage, i.e. its nullity, presence, annulment as well as divorce, can now be registered before Turkish diplomatic missions and Civil Registries that are specified by the Ministry of Interior with joint application of parties or their legal representatives.            

That said, there are some certain conditions that should be found within the relevant foreign judgment. Indeed, latter must be finalized in procedural means and must not be clearly violating Turkish public policy. In a contrary situation, the procedure will be governed by relevant provisions of Turkish International Private and Procedural Law and enforced through competent courts.

Apart from these, details of this recent ratification is to be clarified via an upcoming regulation.
